Contested Divorce - Separate Property Victory
How Did Marcus Gomez Help?
Our client was involved in a contested divorce matter in which the opposing party claimed an ownership interest in real property titled in our client’s name. The opposing party asserted that she was entitled to a share of the property’s value, and during the proceedings, issues involving Moore–Marsden rule calculations were raised regarding potential community property interests. The court initially considered orders requiring our client to pay approximately $60,000 to buy out the opposing party’s claimed interest in the property.
Following a detailed review of the parties’ financial history and property records, our office uncovered a previously executed interspousal transfer deed signed during the marriage. The deed clearly granted our client full and exclusive ownership rights to the property while expressly relinquishing and excluding the opposing party’s interest.
Based on this evidence, the court ultimately determined that the property was our client’s separate property and that the opposing party had no legal entitlement to any ownership interest or buyout payment. As a result, our client was no longer required to pay the previously contemplated $60,000 buyout, and the divorce was successfully finalized.
